1. Introduction and Acceptance

Welcome to CoinMafia ("Platform", "Interface", "we", "us", or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you and CoinMafia. By accessing, browsing, or using the Platform, connecting a cryptocurrency wallet, or interacting with any smart contracts through the Platform interface, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE PLATFORM. Your continued use of the Platform constitutes ongoing acceptance of these Terms and any future modifications.

2. Nature of the Platform

CoinMafia is a decentralized software interface that provides:

• A user interface for interacting with public blockchain networks
• Pre-compiled smart contract bytecode that users may independently deploy to blockchain networks
• Tools for token creation, trading, and community engagement
• Information display services for blockchain data

The Platform is NOT and does NOT operate as:

• A custodian, exchange, broker, dealer, or financial institution
• An investment advisor, financial advisor, or fiduciary
• A money transmitter or payment processor
• A securities exchange or trading platform
• A bank or deposit-taking institution

3. Code and Information as Protected Expression

The Platform publishes pre-compiled smart contract bytecode and related technical information. This bytecode constitutes information and expression that users may choose to utilize at their own discretion. The Platform's role is analogous to that of a publisher, compiler, or development tool provider.

You acknowledge and understand that:

• The Platform publishes bytecode as information; users independently decide whether to deploy it
• Similar to integrated development environments (IDEs), compilers, or code repositories, the Platform provides tools and information without directing user actions
• The decision to deploy any smart contract is solely yours, made through your own wallet and blockchain transaction
• The Platform does not compel, direct, or control any deployment or transaction
• Bytecode can be independently verified against published source code before deployment

4. User-Deployed Smart Contracts

When you use the Platform to create a token, YOU are the party deploying the smart contract to the blockchain network. The Platform merely provides a user interface and pre-compiled bytecode to facilitate this process. Once deployed, smart contracts operate autonomously on the blockchain and are outside the control of the Platform or any centralized party.

You acknowledge and agree that:

• You are solely responsible for any smart contracts you deploy
• The Platform has no ability to modify, pause, or reverse any deployed contracts or transactions
• All blockchain transactions are final and irreversible
• You have reviewed and understand the functionality of any code you deploy
• The Platform is not a party to any transaction you execute

5. Eligibility and Restrictions

To use the Platform, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Have the legal capacity to enter into binding agreements
• Not be a resident or citizen of any jurisdiction where use of the Platform is prohibited
• Not be subject to any economic or trade sanctions
• Not be on any government sanctions list including but not limited to the U.S. OFAC SDN List, EU Consolidated Sanctions List, or UN Security Council Sanctions List

Geographic Restrictions: The Platform is not intended for use in jurisdictions where such use would be prohibited or require licensing or registration. Users are solely responsible for determining whether their use complies with applicable local laws.

6. Prohibited Activities

You agree NOT to use the Platform for, or in connection with, any of the following prohibited activities:

• Money Laundering: Using the Platform to conceal or disguise the origins of illegally obtained funds or to convert illegal funds into legitimate-appearing assets
• Terrorist Financing: Providing or collecting funds with the intention or knowledge that they will be used to carry out terrorist acts or support terrorist organizations
• Sanctions Evasion: Circumventing or attempting to circumvent any applicable economic or trade sanctions, including those imposed by the United States, European Union, United Nations, or any other governmental authority
• Fraud and Scams: Creating tokens or engaging in activities designed to defraud, deceive, or mislead other users, including but not limited to "rug pulls," exit scams, or Ponzi schemes
• Market Manipulation: Wash trading, spoofing, layering, front-running, or any other form of market manipulation or artificial price inflation
• Intellectual Property Infringement: Creating tokens that infringe upon trademarks, copyrights, or other intellectual property rights of third parties
• Illegal Securities: Offering or selling unregistered securities or engaging in activities that violate applicable securities laws
• Illegal Gambling: Operating or participating in unlicensed gambling activities
• Child Exploitation: Any content or activity related to the exploitation of minors
• Illegal Goods/Services: Facilitating the sale or purchase of illegal drugs, weapons, stolen property, or other contraband
• Cybercrimes: Hacking, phishing, spreading malware, or engaging in any unauthorized access to computer systems

We reserve the right to report suspicious activities to relevant law enforcement authorities and cooperate with any resulting investigations.

7. Anti-Money Laundering (AML) Compliance

While the Platform operates as a decentralized interface and does not conduct Know Your Customer (KYC) procedures, users are solely responsible for ensuring their activities comply with all applicable anti-money laundering laws and regulations in their respective jurisdictions. You represent and warrant that:

• All funds used on the Platform are from legitimate, legal sources
• You are not using the Platform to evade any legal obligations or reporting requirements
• You will comply with all applicable AML/CFT (Counter Financing of Terrorism) laws and regulations
• You understand that blockchain transactions are publicly visible and may be traced

8. User Responsibilities

You acknowledge and accept full responsibility for:

• Securing your wallet, private keys, seed phrases, and any other authentication credentials
• All transactions conducted through your connected wallet
• Verifying the accuracy of transaction details before confirmation
• Understanding the risks associated with blockchain technology and digital assets
• Determining the tax implications of your activities and fulfilling all tax obligations
• Ensuring your use of the Platform complies with all applicable laws in your jurisdiction
• Conducting your own research and due diligence before creating or purchasing any tokens

9. Risks and Warnings

You acknowledge and accept the following risks:

• Total Loss of Funds: You may lose 100% of your investment. Only use funds you can afford to lose entirely.
• Extreme Volatility: Token prices can fluctuate dramatically within seconds and may drop to zero.
• Smart Contract Risk: Smart contracts may contain bugs, vulnerabilities, or exploits that could result in loss of funds.
• No Liquidity Guarantee: There is no guarantee you will be able to sell tokens at any price or at all.
• Regulatory Risk: Laws and regulations regarding cryptocurrencies vary by jurisdiction and may change, potentially affecting your ability to use the Platform or the value of tokens.
• Technical Risks: Network congestion, blockchain forks, protocol upgrades, and other technical issues may affect transactions.
• Third-Party Risks: Tokens created by other users may be scams, have hidden mechanics, or be otherwise fraudulent.
• Oracle and Price Feed Risks: Price information displayed may be delayed, inaccurate, or manipulated.

10. Not Investment or Financial Advice

The Platform does not make any recommendations regarding the purchase, sale, or holding of any tokens or digital assets. Any information provided is for informational purposes only. You are solely responsible for your investment decisions and should consult with qualified professionals before making any financial decisions.

Tokens created or traded on the Platform are not securities and have not been registered with any regulatory authority. The Platform makes no representations regarding the legal status of any token in any jurisdiction.

11. No Expectation of Profit from Others' Efforts

You expressly acknowledge and agree that:

• No Managerial Efforts: The Platform does not undertake any managerial, developmental, marketing, or operational efforts on behalf of any token or token creator. Any value a token may have is derived solely from community interest and market dynamics, not from any efforts of the Platform.
• Autonomous Operation: Once deployed, smart contracts operate autonomously according to their immutable code. The Platform has no ability to influence, control, or enhance the value of any token.
• No Profit Promises: The Platform makes no representations, warranties, or promises regarding any potential profits, returns, or appreciation in value of any token. You should not acquire any token with an expectation of profit.
• Community-Driven: Any success or failure of a token is determined entirely by its community, market conditions, and the efforts of its creator and supporters - not by the Platform.
• No Common Enterprise: There is no pooling of funds, no shared enterprise between the Platform and users, and no profit-sharing arrangement of any kind. Each user acts independently.
• Utility Purpose: Tokens are created for community, entertainment, meme, or other utility purposes as determined by their creators. They are not offered or sold as investment opportunities.

By using this Platform, you represent that you are not acquiring tokens with an expectation of profits to be derived from the entrepreneurial or managerial efforts of the Platform or others.

12. Bonding Curve Mechanism and Token Creation

When a user creates a token through the Platform, THEY deploy the bonding curve smart contract directly to the blockchain using their own wallet. The Platform provides pre-compiled bytecode and a user interface to facilitate this deployment, but the user is the sole deployer and controller of the contract.

You understand and acknowledge that:

• Each bonding curve contract is independently deployed by the user who creates the token
• The Platform has no ownership, control, or administrative access to any deployed contracts
• Bonding curves operate autonomously according to their code once deployed
• Buying tokens increases the price; selling decreases it
• Price slippage may occur, especially for larger transactions
• Upon reaching graduation thresholds, liquidity may be migrated to decentralized exchanges in an automated and irreversible process
• Early participants in a bonding curve may have significant advantages over later participants
• The Platform cannot pause, modify, upgrade, or intervene in any deployed contract

13. Trading and Third-Party Tokens

You understand and acknowledge that:

• Peer-to-Peer Trading: All trades occur directly between users and the smart contracts deployed on public blockchains, not with or through the Platform
• No Intermediation: The Platform does not hold, escrow, or custody any funds or tokens at any point during a transaction
• Third-Party Contracts: Tokens and bonding curves are created and deployed by independent third-party users; we do not create, endorse, or guarantee any token
• No Vetting or Audit: We do not audit, verify, or vet any tokens, their creators, or the legitimacy of any project displayed on the Platform
• Display of Public Data: The Platform displays publicly available blockchain data; the inclusion of any token on the Platform does not constitute an endorsement or recommendation
• Scam Risk: Many tokens may be scams, have no value, or be designed to defraud buyers; you trade entirely at your own risk
• No Recourse: We have no ability to reverse transactions, recover funds, or provide any remedy if you are defrauded or lose money
• DYOR: You are solely responsible for conducting your own research and due diligence before purchasing any token

14. Fees

The Platform may charge fees for certain activities, which will be clearly displayed before you confirm any transaction. You are also responsible for all blockchain network fees (gas fees) which are determined by network conditions and are not controlled by the Platform. All fees paid are non-refundable.

You agree to indemnify, defend, and hold harmless CoinMafia, its affiliates, and their respective directors, officers, employees, agents, contractors, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Platform
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any third-party rights, including intellectual property rights
• Any tokens you create or transactions you execute
• Any claim that your activities caused damage to a third party
• Any regulatory action or investigation arising from your use of the Platform

18. Intellectual Property

The Platform's user interface, design, logos, trademarks, and proprietary content are owned by CoinMafia and protected by applicable intellectual property laws. Smart contract bytecode provided through the Platform is made available for deployment purposes only and does not grant any ownership rights. Users retain ownership of content they create but grant the Platform a non-exclusive, worldwide, royalty-free license to display such content.

19. Privacy and Data

The Platform operates primarily through public blockchain networks. All blockchain transactions are publicly visible and permanently recorded. By using the Platform, you acknowledge that your wallet addresses and transaction history are public information. For information about data we may collect through the website interface, please refer to our Privacy Policy.

20. Modifications to Terms

We reserve the right to modify these Terms at any time at our sole discretion. Material changes will be posted on the Platform with an updated "Last Updated" date. Your continued use of the Platform after any modifications indicates your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

21. Termination and Suspension

We reserve the right to suspend, restrict, or terminate your access to the Platform at any time, without prior notice, for any reason or no reason, including but not limited to suspected violation of these Terms, suspected illegal activity, or at the request of law enforcement or regulatory authorities. Due to the decentralized nature of blockchain technology, this may involve blocking access to the interface only, as we cannot control deployed smart contracts or blockchain transactions.

22. Dispute Resolution and Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Platform shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if they qualify. This agreement to arbitrate is intended to be broadly interpreted. You agree to waive any right to a jury trial or to participate in a class action.

23. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. You consent to the personal jurisdiction of courts in the applicable jurisdiction for any actions not subject to arbitration.

24. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

25. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published on the Platform, constitute the entire agreement between you and CoinMafia regarding your use of the Platform and supersede all prior agreements and understandings.
